How the date is worked out
The Department of Justice rule under Title II of the ADA requires state and local government web content, including posted PDFs, to meet WCAG 2.1 Level AA. An interim final rule published and effective on April 20, 2026 moved both compliance dates back one year. Your date depends on your total population, and special district governments always get the later date. The extension moved the technical compliance dates only; existing ADA duties, including effective communication and nondiscrimination, still apply.
50,000 or more
April 26, 2027
Larger cities, counties and school districts, state agencies and most public universities.
Under 50,000, or special district
April 26, 2028
Smaller towns, counties and school districts, and all special district governments.
Common questions
What are the ADA Title II web accessibility compliance dates?
Under the Department of Justice interim final rule published on April 20, 2026, public entities with a total population of 50,000 or more must meet WCAG 2.1 Level AA by April 26, 2027. Public entities with a total population under 50,000, and all special district governments, must comply by April 26, 2028. The extension moved these technical compliance dates only; existing ADA duties, including effective communication and nondiscrimination, continue to apply.
Which population number do we use?
The rule defines total population. A city, county or town uses its population from the most recent decennial Census. An independent school district uses the Census Bureau's Small Area Income and Poverty Estimates (SAIPE) population for the district, not student enrollment. A department, board or other instrumentality of a government uses the population of the government it belongs to, so state agencies and most public universities use the state population. If you are unsure, confirm the figure with your attorney.
Is a school district a special district government?
No. In Census Bureau classifications, independent school districts are counted separately from special district governments, so the automatic 2028 date for special districts does not apply to them. A school district uses its own SAIPE population to find its date.
Does the checker tell us which PDFs are exempt?
No. Enter only the pages you have identified for remediation. The checker does not decide whether any document falls under an exception such as archived web content or preexisting documents. That is a legal question for your attorney.
How is the cost estimate calculated?
Standard pages are priced at $6 and complex pages (tables, forms or scanned pages) at $12, the ClearLayer Access list prices for standard delivery. For example, 100 PDFs of 10 pages with 25% complex pages is 750 x $6 + 250 x $12 = $7,500. It is a planning figure, not a quote.
